Regulation: new rules for recycled plastic

A new decree, issued on 23 April, updates the provisions applicable to recycled plastic materials and articles intended to come into contact with foodstuffs.

The decree of 23 April 2024, which amends article R412-38 of the French Consumer Code relating to recycled plastic materials and articles intended to come into contact with foodstuffs, is designed to ensure compliance with European Union law.
As the Legal and Administrative Information Directorate explains, this decree replaces the references to the repealed regulation (EC) no. 282/2008 with those relating to regulation (EU) 2022/1616.
‘This new regulation lays down uniform rules for the decontamination of recycled plastic materials and objects intended to come into contact with foodstuffs (packaging, trays, etc.). This framework will help to build confidence in recycled plastic among consumers and the food industry”, says the Directorate.

A wide range of areas

The new provisions include requirements relating to :

  • materials and objects made from recycled plastic ;
  • documentation and labelling;
  • new recycling technologies;
  • recycling facilities using new technology;
  • monitoring and reporting of contamination levels;
  • authorisation of a recycling process;
  • the compliance control summary sheet and verification of the operation of a decontamination facility;
  • the declaration of compliance.
